Liability Waiver: In consideration of receiving coaching and being allowed to participate in workouts (swims, rides run, etc) and events, activities and coaching programs (“activities”) of ScriptFit, LLC (D.B.A. FLYT Performance) and to receive advice and coaching from staff about topics including, but not limited to, proper technique and form, use of equipment, and training and racing routines, in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge ScriptFit, LLC (D.B.A FLYT Performance) and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf from any and all responsibilities or liability for injuries or damages including damages to myself resulting from my participation in any activities, coaching, or arising out of or connected to my participation in any activities, or use of equipment, and including any damages or injuries that may be caused by the negligent act or omission of ScriptFit, LLC (D.B.A FLYT Performance), and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf. Furthermore, I understand and am aware that activities including but not limited to strength and flexibility training, cycling, triathlon, running, swimming, and aerobic and anaerobic exercise, including the use of equipment, are potentially hazardous activities. I also understand that fitness activities involve a risk of injury and even death, and I expressly declare that I am voluntarily participating in these activities and using equipment with knowledge of the dangers involved. I do hereby defend, indemnify and hold harmless ScriptFit, LLC (D.B.A FLYT Performance), and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf for any claim I or my heirs or assigns may have, and I expressly assume and accept any and all risks of injury or death. I irrevocably waive any claim I or my heirs or assigns may have against ScriptFit, LLC (D.B.A FLYT Performance) and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf for any risk of injury or death. I do hereby further declare myself to be physically sound and suffering from no condition, disease, infirmity or other illness that would prevent my participation in any activities of FLYT Performance. I hereby acknowledge that I have been informed of the need for a physician’s approval for my participation in an exercise or fitness activity. I acknowledge and expressly declare that I have either had a physical examination and have been given a physician’s permission to participate or that I have decided to participate in activities and/or use of equipment without the approval of a physician and do hereby assume all responsibility for my participation and activities. 

By purchasing,  I agree to above contract and release of liability.
